Asset Recoveries and
the Truth About Your Debt

Many people like yourself have noticed with shock that these debt
collecting firms will generally insist on speaking to you by phone.
For some strange reason they always prefer to use the phone rather than
communicate in writing. The reason is that they wouldn't be able to
make the same threats on paper because they wouldn't wish to impeach
themselves in writing.
Assuming that you are having to deal with Asset Recoveries then you
can be reassured that a lot of the things that they are using to distress
you are unlawful or have become so. These debt collecting companies
appear under very little obligation, or so it might appear, to do anything
to improve their conduct unless ordered to do so by the OFT (Office
of Fair Trading) or similar body.
Certainly, it is true that some debt purchasing companies (DPCs) are
worse than others. Some DCAs have a speciality in sending out speculative
letters telling people that they owe money knowing full well that they
owe nothing to anyone. This tactic seems to work well for the debt collection
agencies for the reason that they are quite aware that a small percentage
of scared people will give in to their threats although they know full
well they have bo debts. The worst of these debt purchasing firms buy
lists of debtor accounts which are more than six years old and try to
profit from these. But this is illegal. These debts are classified as
Statute Barred, and their recovery cannot be legally enforced.
Always insist on dealing with the DPCs by post. Never give out any
phone numbers. The problem is at first they'll say they are calling
from the bank or credit card company and make you feel more obliged
to comply. They want you to be as unaware of the facts as possible,
so they wish to create as much confusion as possible: here Asset Recoveries
will have the best result for them. As soon as they get hold of your
details they will use it to worry you, even to frighten you. The law
is there to stop this happening but the problem is that most people
just don't know what to do and it is very clear that the debt collecting
firms will use this to their own advantage. Public bodies such as the
excellent CCCS (Consumer Credit Counselling Service) or the Citizen's
Advice Bureau are fantastic but sometimes they are overburdened and
there are times when such advice is lacking in detail.

card.
